Terms of sale

These terms govern the sale of digital products from dariuszmotyka.com (“the Site”), operated by Dariusz Motyka (“we”, “us”). By purchasing, you agree to these terms.
1. The products
We sell digital products (downloadable guides, templates, spreadsheets and interactive files), including The CQC Evidence Operation toolkit. Products are delivered electronically; nothing physical is shipped.
2. Orders and payment
Payments are processed by our reseller and merchant of record, Lemon Squeezy (Lemon Squeezy, LLC). Lemon Squeezy handles the transaction, issues your receipt/invoice and collects any applicable VAT or sales tax. Your purchase is also subject to Lemon Squeezy's terms.
3. Delivery
Access to download the product is provided immediately after successful payment, by on-screen link and/or email. Please keep your copy safe; you are responsible for downloading and storing the files.
4. Licence and permitted use
On purchase you receive a non-exclusive, non-transferable licence to use the product within your own organisation for your own business purposes. You may not resell, sublicense, redistribute, publish, or share the product or its contents outside your organisation, and you may not represent it as your own. All intellectual property remains with us.
5. Nature of the product — important
The products are practical guidance from an operator's perspective. They are not legal, regulatory, financial or professional advice, and they are not affiliated with, endorsed by, or connected to the Care Quality Commission (CQC). You remain responsible for your own regulatory compliance and should always work from the CQC's current published guidance and take professional advice where appropriate.
6. Disclaimers and liability
The products are provided “as is”. To the fullest extent permitted by law, we exclude all warranties not expressly stated and accept no liability for any loss arising from use of, or reliance on, the products, including any regulatory outcome. Nothing in these terms limits liability that cannot be limited by law. This does not affect your statutory rights as a consumer.

8. Updates
We may update a product (for example, to reflect changes to the CQC framework). Where we issue an update to a version you bought, we will make reasonable efforts to make it available to you.
9. Governing law
These terms are governed by the laws of England and Wales, and disputes are subject to the courts of England and Wales.
